CLAWBACK DEFENSES

APPLICABLE STATUTE OF LIMITATIONS

Every state has their own statute of limitations. If the Receiver or the Trustee will be making fraudulent transfer or fraudulent conveyance claims, the statute of limitation will limit how far back they can go to try to recover transfers. For example, in Florida, the statute of limitations for these types of claims is four years. In New York, the statute of limitations is six years.
